The Terms and Conditions set out below are the basis of the full Agreement between you, the Client and Patricia Soper, the Artist. It is important that the Client reads the T’s & C’s in full prior to making a booking. If the Client has any queries please contact the Artist before making a booking. By proceeding to book the Artist, the Client is accepting these Terms and Conditions. The T’s & C’s will be incorporated in to the Agreement between the Client and the Artist.
The ARTIST: Patricia Soper Makeup & Hair Artist
The CLIENT: The recipient of the service and name on the booking form/agreement
The BOOKING FEE: Non refundable Booking Fee to secure the date of the event for the Artist’s services
The BOOKING FORM/AGREEMENT: The booking form completed and signed by the client for the agreed services and for the agreed fee therefore constitutes the AGREEMENT between the Client and the Artist.
The FEE: The amount payable by the Client to the Artist
The AGREEMENT: The contract between the Client and the Artist for the agreed services and for the agreed fee
The SERVICES: Makeup/Hair for the consultation/trial, any additional trials the occasion/event date
The EVENT: The occasion/wedding date for which the service’s of the Artist has been agreed
The PARTY: Party members/guests of the Client
3. BOOKING - Securing the event date
a. From the initial enquiry, the Artist will send the Client a Booking Form/Agreement and information to make the Booking Fee payment. The Booking Fee secures the Clients wedding/event date. If the Artist does not receive the Booking Fee a wedding/event date will not be secured/reserved.
b. Upon receipt of the Clients Booking Fee by the Artist, the Artist will confirm that the wedding/event date is secure and reserves the Artist's availability and services for the agreed Wedding/Event date.
c. The Booking Form/Agreement is to be completed, signed and dated by the Client and returned to the Artist via email or post (Recorded Delivery). If the Client does not have all details of bridal party, photographer details for example, this can be added at a later date.
d. The Artist will confirm to the Client via email receipt of the Booking Fee and receipt of the completed Booking Form/Agreement.
e. After the Client’s Booking Fee has been received and confirmed by the Artist a trial date can then be arranged that is convenient for the CLIENT AND ARTIST or the Client can choose to arrange the trial at a later date that convenient for both the Client and the Artist nearer to the Event date.
4. TRIAL ONLY – Non payment of Booking Fee
a. Enquiries where the Booking Fee has not been received by the Artist the booking is not confirmed and therefore the Event date and availability and services of the Artist cannot be guaranteed.
b. If a Client chooses to have a trial to establish if the Client wishes to proceed to make a booking Agreement or not, the trial is to be carried out as soon as possible.
c. If the Client feels some extra time is needed after the trial before making a decision to book the Artist’s services for the Event, then the trial Fee is payable to the Artist (this DOES NOT constitute as a booking Agreement).
d. An agreed time frame is put in place for the Client to notify the Artist of her decision. The Artist will email the Client to confirm this.
e. Notification from the Client must be made via email to the Artist. Verbal notification is not accepted as confirmation from the Client.
f. Once this time has lapsed the date will be made available to new inquiries or to anyone else who has previously enquired for that Event date.
5. PROCEEDING/CONFIRMING THE BOOKING AGREEMENT
5.1 Client has paid the Artist's Booking Fee
a. On completion of the trial the Artist will ask the Client if they are completely happy with the outcome of the makeup and hair styling.
b. If the Client confirms that they are completely happy and wishes to engage the Artist for the Event, it is at this point that Client’s makeup/hair Fee for the Event is payable to the Artist.
c. The Client and the Artist will confirm Party members as stated on the Client’s Booking Form/Agreement for the Event date.
d. After the trial if any additional Fee’s are payable to the Artist, see Events below, these will be agreed between the Client and the Artist.
e. The Client’s makeup/hair Fee for the Event will be required to PROCEED with the booking for the Event date. This CONFIRMS the booking Agreement.
f. The Client’s makeup/hair Fee for the Event date is non refundable.
5.2. Trial only Clients
a. After the trial is completed if the Client notifies the Artist of her wish to proceed to book the Artist’s services for the Event date
b. Full payment for the Client’s makeup/hair for the Event date is payable to the Artist plus the trial Fee if the trial Fee has not received by the Artist prior to the trial date.
c. The Client’s makeup/hair Fee for the Event will be required to PROCEED with the booking for the Event date. This CONFIRMS the booking Agreement.
d. The Client’s makeup/hair Fee for the Event date is non refundable.
6. PAYMENT TERMS
6.1 Booking Fee
a. The Booking Fee is to be paid to the Artist when the Client wishes to secure the Artist’s availability/services for the Event on the agreed date, time and location for the agreed Fee.
b. Booking Fee – UK Makeup & Hair £120 / Makeup OR Hair £80 - Destination wedding/event - £200
c. The Booking Fee is deducted from final balance of the booking Agreement Event Fee.
d. The Artist will confirm receipt of the Booking Fee via email to the Client.
e. The Booking Fee is non refundable.
6.2 Trial Fee – The Client has paid the Artist the Booking Fee.
a. The Client’s trial Fee is to be received by the Artist three days prior to the trial date via bank transfer, or, paid in cash on the day.
b. The Artist will confirm receipt of the trial Fee via email to the Client.
c. The trial fee is non refundable.
6.3 Trial Only Fee
a. The trial only Fee is to be paid in cash to the Artist on the trial date.
b. Or via bank transfer to be received by the Artist three days prior to the trial date.
c. The Artist will confirm receipt of the trial Fee via email to the Client.
d. The trial Fee is non refundable.
7. CONFIRMING THE BOOKING/AGREEMENT FEE
7.1 The Client has paid the Artist’s booking Fee.
a. The Client’s makeup/hair Fee for the Event is payable to the Artist to PROCEED with the booking. This CONFIRM’s the booking Agreement.
b. The Client’s makeup/hair Fee is to be received by the Artist on the day of the trial date if paid in cash.
c. Or, via bank transfer to be received by the Artist within 7 days from the Client’s trial date.
d. On receipt of the Client’s makeup/hair Fee the Artist will confirm the booking Agreement via email.
e. The Client’s makeup/hair Fee for the Event is non refundable (See Cancellations below).
7.2 Trial Only Clients
a. Full payment for the Client’s makeup/hair fee for the Event date is payable to the Artist plus the trial Fee.
b. If the trial Fee has been received by the Artist prior to the trial, the Client’s makeup/hair Fee for the Event date is required by the Artist at the trial to be paid in cash or paid via bank transfer within 7 days from the date of the trial.
c. If the trial Fee has not been received by the Artist prior to the trial date, full payment of the trial Fee and the Client’s makeup/hair Fee for the Event date is required in cash by the Artist on the day of the trial.
d. The trial Fee and Client’s makeup/hair Fee for the Event date are non refundable. (See Cancellations below).
8. FINAL BALANCE OF THE EVENT FEE
a. Full payment of the final balance for the Event of the Booking Agreement Fee is required 4 weeks prior to the date of the Event via bank transfer or cheque.
b. The only exception to this is where the Client has agreed with the Artist to pay the Fee in cash on the day.
The Artist’s services as stated on the Booking Form Agreement.
c. Party member/members fees for makeup/hair
d. Travel expenses, parking and congestion charges where applicable
e. After the Client’s completed trial if there are any fees owing to the Artist these will be added to the Final balance of the Event Fee.
f. Reimbursement owed to the Artist for products purchased on behalf of the Client or Party members
g. Hire of hair pads, hair accessories, hair extensions.
9. LATE BOOKINGS
a. If the date of the Event is less than three weeks away full payment of the Event Fee is required to CONFIRM the booking Agreement.
b. The full Event Fee is required on the trial date.
c. The Client can make the Fee payment via bank transfer (to be received by the Artist prior to the trial date) or cash at the trial.
10. ADJUSTMENT TO BOOKINGS
a. If the Client wishes to make adjustments to a secured booking the Artist must be notified in writing and agreement for said adjustments confirmed by the Artist.
b. If the Party numbers increase and the Artist sees it necessary for an additional artist to assist to ensure all Party members are completed within the previously discussed time frame, additional Fees will be applied.
c. If the Party numbers reduce within 30 days prior to the Event, the full payment of the balance Event Fee remains payable.
11. RESPONSIBILITY OF THE CLIENT
a. It is the Client’s responsibility to inform the Artist of any potential issues, medical conditions, allergies and/or sensitivities or any other conditions that the Artist should be made aware of.
b. The Client must inform the Artist of any issues that may affect the use of any equipment and or products at the time of booking.
c. The Artist cannot be held liable for any condition that arises or loss incurred by the Client if the Client has not informed the Artist via email of any known conditions as stated above, or of any condition unknown to the Artist at the time of the booking or service being carried out.
d. The Client must inform the Artist of any subsequent reactions to any products used by the Artist, so amendments can be made before the Event.
e. The Client must inform the Artist of any cancellation of consultation or trial appointment as soon as reasonably practicable.
f. Less than 24 hours notice will result in the relevant fee being applied and payable to the Artist.
g. The above (11.f.) will be waived if there is a situation of unforeseen ill health, emergency or an urgent family emergency.
h. The Client must inform the Artist if they have a contagious illness/virus i.e. cold, stomach upset, eye infection, cold sores, just prior to a consultation/trial. In this instance a new date may well have to be set.
i. It is the Client’s responsibility to ensure timings for makeup/hair on the Event date (which were agreed with the Artist prior to the Event) are passed on to all Party members.
j. If the Client and/or Party member/members arrive later than the timings schedule for the Event, the Artist cannot be held responsible/liabable for not fulfilling her obligations as stated in the booking form Agreement or to the Artist’s high standard of work due to unforeseen time restraints.
k. The Artist reserves the right to refuse her services to the Client or Party member for, but not limited to, abusive and threatening behavior.
12.1 Cancellation by the Artist
a. If the Artist is unable to fulfill her obligations to the Client due to unforeseen severe ill health, injury, accident, emergency, or an urgent family emergency this will be dealt with in a professional manner.
b. If the Artist is unwell but fit enough to fulfill her obligations to the Client, the Artist will notify the Client if there is any concern of contagiousness.
c. If the Client refuses the services of the Artist, as above (12.1.b), this would be the decision of the Client and deemed as a cancellation by the Client. Cancellations Fees may be applied.
d. A substitute artist or artists will be offered from the Artist’s extensive list of contacts.
e. A full refund of any Fee’s paid (including Booking Fee) to the Artist by the Client will be offered to the Client.
12.2 Cancellation by the Client
a. Cancellation of a secured booking Agreement by the Client will only be valid in writing via email and can only be confirmed once your cancellation has been received and acknowledged by the Artist.
b. A cancellation must be received no later than 12 weeks prior to the Event date.
c. A cancellation received by the Artist less than 12 weeks to the Event the outstanding full Booking Agreement Event Fee is payable.
d. Payments that have already been received by the Artist for an Event will be retained.
13. PHOTOGRAPHY AND USE OF IMAGES
a. The Artist may request the Clients professional photographer permission to use the professional photographic/video images on the Artist's website and/or other promotional material/avenues.
b. Without the consent of the Clients professional photographer, the Artist will not use any professional photographic or video images on the Artist’s website or other promotional material/avenues.
c. The Artist reserves the right to use any photographic images taken by the Artist, to use on the Artist's website or other promotional material/avenues.
d. The Client must notify the Artist prior to booking the Artist if the Client does not wish any photographic images taken by either the professional photographer or the Artist to be used on the Artist's website or other promotional material/avenues.
The Artist is not liable for any other supplier who the Artist recommends to the Client. Whether working with the Artist on the Client Event date, and/or if the supplier/suppliers are for a Client that Artist is not working with.
The Artist has public liability cover.
All information provided by the Client shall be treated with the upmost confidentiality and will only be available to the Artist. If the Artist receives an enquiry where the Artist is booked and sources another artist, The Artist may request permission to pass on the details of the person making the enquiry to another artist.
ADDITIONAL IMPORTANT INFORMATION
Individual lash application is included in the price for the Artist’s makeup service. If the service is declined there is no reduction in price.
Repeat trials – the same Fee applies as for the first trial.
Travel costs - Travel costs will be charged at £0.45 per mile from RG24 8BD return trip. Parking and congestion charges will be added where necessary.
Hire of hair extensions, hair pads or hair accessories - The Client is to return items to the Artist within 3 weeks from the date of the Event. Failure to do so will incur payment to be made to the Artist for replacement of the item.
It is recommended that the Client take’s out the appropriate insurance, for example wedding insurance to assist should any problems arise, for example, cancellation of the Event or the Event has to be rescheduled.
